APP Filing (APP备案)
Definition
APP filing (APP备案) is the ICP registration for native mobile applications whose backend domains resolve to servers in the Chinese mainland. It runs through the same MIIT pipeline as the website ICP filing but is a separate service registration under the same filing subject. The Ministry of Industry and Information Technology (MIIT) published the dedicated APP-filing work plan in notice 工信部信管〔2023〕105号 (issued 2023-08-04), which sets out the phase windows and the distribution bar for unfiled apps. Apps are a first-class filing object under the same regulations that govern websites — the Internet Information Services Measures (State Council Decree 292) and the Non-commercial Filing Measures.
What APP filing is
- A first-class filing object, not an afterthought. Alibaba Cloud's filing documentation states: "Websites, apps, and other services with domain names resolving to servers in the Chinese mainland must obtain an ICP filing before providing services." Tencent Cloud's filing overview confirms the same rule and exposes parallel "网站备案" (website filing) and "APP 备案" (APP filing) paths in every filing scenario — first filing, add-service, and access filing.
- Same pipeline, separate service registration. The APP filing runs through the hosting provider's portal, the MIIT SMS verification from 12381, and the provincial communications administration review — the same stages as the website filing. The APP filing number hangs off the subject number as a separate serial with an
-Asuffix (e.g. the pattern 鲁ICP备09090609号-2A). Change, cancel, and access-filing operations treat websites, apps, and Mini Programs symmetrically. - Governed by a dedicated MIIT work plan. Notice 工信部信管〔2023〕105号 ("关于开展移动互联网应用程序备案工作的通知") sets the phase windows: preparation through August 2023; existing (存量) APP filings September 2023 through March 2024; supervisory inspection April through June 2024. Apps distributed after the notice must complete filing before launch. The legal basis for the app-filing duty also includes the Anti-Telecom Fraud Law, Article 23, which requires apps to complete licensing or filing with the telecom authority.
- Subject to a distribution bar. Section (九) of the notice states that access providers, distribution platforms, and smart-terminal manufacturers must not provide network access, distribution, or pre-installation for unfiled apps. This is the enforcement lever at the store and terminal level — it sits alongside the provider-level domain blocking that already applies to unfiled websites. How stores enforce it — the China Android app stores landscape.
- Tied to the mainland-server trigger. An app whose backend domain resolves to a mainland server must file — the app itself does not change the compliance picture; what matters is where the backend lives and what the service does. An API-only backend still files ICP, though Tencent's scenario documentation exempts API-only services (no user-facing web content) from the follow-on public-security network filing.
What APP filing is not
- Not the website filing. The APP filing is a separate service registration under the same subject. It does not replace or absorb the website filing. A mainland-hosted backend domain still needs its own website ICP filing; the APP filing covers the app as a distinct service.
- Not a store-removal mandate with a dated sweep. The MIIT notice states a distribution bar (§九) and a supervisory inspection phase (April–June 2024). It does not state that app stores removed unfiled apps on any specific date. The 2024-03-31 date you may see cited in this context is WeChat-platform-scoped — the deadline after which legacy Mini Programs could no longer submit version reviews unfiled. It is not a store-removal date. The notice itself sets no dated removal sweep, but individual stores published their own schedules — vivo's developer documentation, for example, blocks version updates for unapproved library (存量) apps from 2023-12-12 and gradually removes unapproved existing apps from 2024-01-04: store-side enforcement under vivo's own APP核准(备案) guide, distinct from the notice text.
- Not available to a Hong Kong entity alone. The filing holder must be a mainland-registered company or qualifying partner — typically a WFOE. A Hong Kong entity alone does not qualify. No official statement covers overseas subjects for native-app APP filings.
- Not the ICP license. The filing registers a mainland-hosted service. The ICP license is a separate, longer permit for commercial online platforms and paid services. The trigger is what the product does, not the filing type.
Why APP filing matters for foreign companies
The mainland-server trigger applies to apps the same way it applies to websites. Any deployment on Alibaba Cloud or Tencent Cloud mainland regions starts the filing obligation. The provider's monitoring system identifies and blocks unfiled domains resolving to mainland servers — HTTPS included. The APP filing does not change this; it extends it to the app as a registered object. A game app clears this same gate and one more: the NPPA version-approval regime for game apps.
The distribution bar closes the unfiled-app path at multiple points. Enforcement is not limited to one layer — it runs from the access provider through the distribution platform to the device maker. An unfiled app has no compliant route to network access, store distribution, or pre-installation. To distribute an app in China at the store layer, the filing must exist first — that is the sequencing the notice sets out.
The same filed entity underpins the app, the backend, and the WeChat ecosystem. The entity that holds the APP filing is the same entity that holds the website ICP filing, the Mini Program registration (if applicable), and the WeChat Pay merchant account. Keep all registrations under one mainland entity from the start.
Common misconceptions
"Only websites need an ICP filing." Apps are a first-class filing object. Both Alibaba Cloud and Tencent Cloud expose parallel website-filing and APP-filing paths. The MIIT notice 工信部信管〔2023〕105号 governs the APP-specific process.
"App stores removed unfiled apps starting April 2024." The notice contains no such dated-removal mandate. It states a distribution bar (§九 — access providers, distribution platforms, and terminal makers must not provide access, distribution, or pre-installation for unfiled apps) and a supervisory inspection phase (April–June 2024). These are different instruments — though individual stores, vivo among them, published dated enforcement schedules of their own.
"Our website filing covers the app." It does not. The APP filing is a separate service registration. Filed APP domains support replacement without cancellation in change-filing flows where website domains do not — but the two registrations are distinct.
Frequently asked questions
What triggers the APP filing obligation — the app itself or the backend?
An app whose backend domain resolves to a server in the Chinese mainland must file. The app itself does not change the compliance picture — what matters is where the backend lives and what the service does. Any deployment on Alibaba Cloud or Tencent Cloud mainland regions starts the filing obligation, the same way it does for a website.
Do we need both a website ICP filing and an APP filing?
Yes, if you operate both a mainland-hosted website and a mainland-hosted app. The APP filing is a separate service registration under the same subject — it does not replace or absorb the website filing. A mainland-hosted backend domain still needs its own website ICP filing; the APP filing covers the app as a distinct service.
What happens if our app goes live without APP filing?
The hosting provider’s monitoring system identifies and blocks unfiled domains resolving to mainland servers — HTTPS included. Beyond the hosting layer, the distribution bar closes the unfiled-app path at every layer: access providers must not provide network access, distribution platforms must not provide distribution, and smart-terminal manufacturers must not provide pre-installation for unfiled apps.
Who can hold an APP filing — can our overseas entity file directly?
The filing holder must be a mainland-registered company or qualifying partner — typically a WFOE. A Hong Kong entity alone does not qualify, and no official statement covers overseas subjects for native-app APP filings. The filing process runs through the hosting provider’s portal, with MIIT SMS verification and provincial communications administration review.
How does APP filing relate to Mini Program filing?
Change, cancel, and access-filing operations treat websites, apps, and Mini Programs symmetrically. The same filed entity holds the APP filing, the website ICP filing, the Mini Program registration, and the WeChat Pay merchant account. Mini Programs are a first-class filing object, like apps and websites — the vehicle choice is a product decision layered on the same compliance foundation.
