Do WeChat Mini Programs Need an ICP Filing? The 2023 Rule Foreign Brands Missed

September 28, 2026

TL;DR

  • Yes — Mini Programs need an ICP filing. WeChat opened the platform filing entry on 2023-09-04. Publishing an unfiled program fails with error 86369.
  • The flow runs four stages after you submit: platform initial review (1–2 working days) → MIIT SMS verification within 24 hours → provincial communications administration review (1–20 working days) → the filing number is issued and auto-displays on the program's profile page after publishing.
  • Some categories must clear another regulator first — publishing and games, online audio-visual, pharmaceuticals, news — and without that approval document the filing is rejected.

The 2023 gate: WeChat publishes no Mini Program without a completed ICP filing — unfiled programs fail with error 86369

Your team picked the Mini Program as the China vehicle — good. Before you ship, you hit a compliance gate most global brands discover too late: since September 2023, every WeChat Mini Program needs an ICP filing (Bei'an) before WeChat will publish it. An unfiled program gets no warning. It just fails.

If you are still choosing between a Mini Program, an H5 page, and a native app, start with which vehicle fits your China use case — then come back here for the filing itself. This article maps the five-stage flow, the pre-approval categories that pull in other regulators, and the blockers that catch foreign-owned teams off guard.

The Short Answer and the 2023 Gate

The legal duty to file apps and Mini Programs with the telecom authority predates 2023. What changed on 2023-09-04 is that WeChat opened the platform filing entry for new, unpublished Mini Programs. Before that date there was no place to submit. After that date, the filing became the prerequisite for listing.

The flow for new programs runs through the Mini Program admin console. Legacy programs that were already live before the gate opened file through a separate entry on the settings page and a homepage prompt, with dynamic daily quotas that refresh at 10:00 the next day. Per the platform FAQ, legacy programs that remained unfiled could still submit version reviews until 2024-03-31 — the de facto line after which filing gates all updates.

The enforcement mechanism is blunt: publishing an unfiled Mini Program fails with error 86369 (“小程序上架需先完成备案” — “Mini Program listing requires completed filing first”).

The legal basis cited in the official operation guide includes the Anti-Telecom Fraud Law (Article 23, requiring apps to complete licensing or filing with the telecom authority), the Internet Information Services Measures (Articles 4–5), and the Non-commercial Filing Measures (Articles 5, 11, 13).

Who Files, and Under Which Entity

The organizer — the entity that registered the Mini Program — is the filing subject. The filing form's subject fields are validated against the Mini Program registration subject's registry data: the company name, registered address, and unified social credit code you enter must match what the business registry holds for that subject. Letter case and full-width versus half-width characters both matter.

The documented quota ceilings are:

Subject typeMaximum Mini Programs
Individual5
Individual industrial-commercial household5
Enterprise, government, media, other organization50

These are ceilings, not targets. The platform also enforces daily submission quotas for legacy filings, which adjust dynamically.

On the entity side, the filing holder must be a mainland-registered company or qualifying partner — typically a WFOE (Wholly Foreign-Owned Enterprise). A Hong Kong entity alone does not qualify. The same filed entity underpins three things: the Mini Program itself, the domain filing for any backend APIs, and the WeChat Pay merchant account that collects payment inside the program. Keep all three under one entity from the start. See which WeChat Pay path fits your entity.

Once a program under the same subject passes filing review, the admin console offers a material-reuse feature. The platform obtains a verification code from the subject responsible person of that subject's most recently approved filing, and later programs can skip re-entering the same materials.

The Five-Stage Mini Program Filing Flow and the Real Timeline

Stage 1 — Fill the form. You submit entity certificates, subject and program responsible-person IDs, a live photo of the program responsible person, a commitment letter, and any pre-approval documents (more on those below). The platform provides a verification form you complete as part of the submission.

Stage 2 — Platform initial review: 1–2 working days. WeChat reviews the materials in-platform. Results arrive as in-platform messages. Keep phones reachable during this window — verification callbacks come from listed 0755 (Shenzhen) numbers.

Stage 3 — MIIT SMS verification: within 24 hours. After initial-review approval, the Ministry of Industry and Information Technology (MIIT) sends an SMS from 12381, typically 5–10 minutes after the approval message. Complete verification at beian.miit.gov.cn within 24 hours: enter the verification code, the phone number, and the last six digits of the responsible person's ID. You get a maximum of five attempts. If unverified after 12 hours, the system auto-resends once. Past 24 hours, the filing is returned and must be resubmitted from scratch.

The SMS recipient depends on filing type: first filings go to the subject responsible person, program-only additions or changes go to the program responsible person, and subject changes go back to the subject responsible person.

Stage 4 — Provincial communications administration review: 1–20 working days. The filing moves to the provincial-level regulator. No action is required from you during this window unless the regulator requests supplementary materials.

Stage 5 — Filing number issued. After approval, the filing number auto-displays on the Mini Program's profile page once the program is published. There is no manual display step — unlike a website footer, you do not paste the number anywhere yourself.

If the filing is rejected at any review stage, a re-review runs within 7 working days after you resubmit corrections. You can withdraw the filing any time before it reaches the provincial communications administration — not after. Website filings have their own rejection mechanics — provider pre-review first, then fix-and-resubmit rounds — see the website filing timeline's rejection walkthrough.

Mini Program Pre-approval Categories: When the Filing Waits on Another Regulator

Certain Mini Program categories require an approval document from a separate regulator before the ICP filing can proceed. The approval document is submitted to the provincial communications administration together with the filing. Without it, the filing is rejected.

CategoryApproving authorityRequired document
Publishing, including gamesNational Press and Publication Administration + provincial press departmentsOnline Publishing Service License

Off-campus tutoringEducation departmentTutoring approval document
ReligionReligious affairs department at provincial level or aboveReligious affairs approval
Internet financeFinancial regulators (PBoC for payments; local financial regulatory bureau for lending/insurance/trust/consumer finance; CSRC for fund sales/equity crowdfunding)Financial regulatory approval

There is also a name-screening gate: Mini Program names containing keywords from the pre-approval domains — publishing, broadcasting, news, pharmaceuticals, medical, tutoring, religion, ride-hailing, finance — are blocked at the filing entry until the name is changed.

For foreign brands: standard retail, D2C, and lifestyle Mini Programs rarely trigger pre-approval. Check the table before filing, not after a rejection. Running a game through that gate? See what the NPPA approval layer means for games.

Foreign-Brand-Specific Blockers

Four issues trip up foreign-owned teams:

  1. Face verification fails for Hong Kong, Macau, and Taiwan administrators. The platform's face-recognition step does not support non-mainland ID documents. Switch to a mainland administrator before starting the filing.
  2. Recently registered or changed entities can fail the business-registry comparison. If the company was incorporated or had its registration details changed recently, the platform's data check may not match. The FAQ suggests retrying after 5–15 working days to allow registry data to propagate.
  3. The entire flow runs in Chinese. The filing platform, notifications, platform verification callbacks, and regulator communications are all in Chinese. The official documentation is available in bilingual form, but the filing UX itself is the Chinese WeChat platform. Plan who handles these communications before you start.
  4. One phone number per person. Contact phone numbers and email addresses are bound per individual — you cannot share contact details across different people in the filing.

Mini Program Filing vs Your Website Filing vs the License

These are separate registrations that share the same provincial communications administration pipeline. A Mini Program filing does not replace your website's ICP filing, and vice versa. Native apps file the same way — see APP filing in China.

Mini Programs call backend APIs. Those APIs need mainland hosting, and any domain resolving to a mainland server must complete its own ICP filing. The Mini Program does not remove that requirement.

If the Mini Program sells goods or services for payment, assess whether the ICP license (as distinct from the filing) is also needed. The filing covers informational and basic online presence; the license covers commercial paid services. The filing and the license are different instruments — see ICP filing vs ICP license for the distinction.

One note on timelines: the 2–4 week figure commonly cited for website filings refers to the website pipeline. Mini Program filings have their own documented stage windows (1–2 working days platform review, 24-hour MIIT SMS, 1–20 working days provincial review) — do not paste the website estimate onto the Mini Program flow. The two pipelines stay separate under the same filed entity — the China launch sequencing map shows where each fits.

Which Filing Path Fits Your Situation

Seven situations we see most often. Each row gives a recommendation and the specific thing to verify before you act — never a promise of outcome. The filing obligation underneath the program is the same Bei'an (ICP filing) that covers websites. After approval, the filing number auto-displays on the program's profile page — programs have no footer step, unlike websites.

Website-filing rejections follow their own catalog — see rejection reasons on the website pipeline.

Frequently Asked Questions

Do WeChat Mini Programs need an ICP filing?

Yes. WeChat opened the platform filing entry on 2023-09-04. Publishing an unfiled Mini Program fails with error 86369. The legal basis is the Anti-Telecom Fraud Law Article 23 and the Internet Information Services Measures.

How long does Mini Program filing take?

Platform initial review takes 1–2 working days. MIIT SMS verification must complete within 24 hours. Provincial communications administration review takes 1–20 working days. A rejected filing re-reviews within 7 working days after resubmission.

Which Mini Program categories need pre-approval?

Publishing including games (National Press and Publication Administration), online audio-visual (NRTA), pharmaceuticals and medical devices (provincial drug regulator), and news (cyberspace administration) are the most common. Culture, tutoring, religion, ride-hailing, and internet finance each have their own approving authority. Without the approval document, the filing is rejected.

Does the Mini Program filing replace our website's ICP filing?

No. They are separate registrations. A mainland-hosted backend still triggers the website filing, and paid services still require the ICP license assessment. The Mini Program filing covers the program itself; the website filing covers domains resolving to mainland servers.

Can our Hong Kong-based admin complete the face verification?

No. Administrators from Hong Kong, Macau, and Taiwan cannot complete the platform's face verification step. Switch to a mainland administrator before filing.

Does every Mini Program need a filing — any exemptions?

Every program is filing-gated. Newly registered programs have needed a filing to publish since 2023-09-04. Legacy programs that were already live could submit version reviews unfiled only until 2024-03-31. No exemption path is documented.

Personal vs company subject — which to register under?

The organizer — the entity that registered the Mini Program — is the filing subject. Quota ceilings are 5 programs for an individual, 5 for an individual industrial-commercial household, and 50 for an enterprise or other organization. A paid program needs the same filed entity as the WeChat Pay merchant — an organizational subject for any D2C operation.

What is the 12381 SMS step and what if we miss it?

After platform initial-review approval, MIIT sends an SMS from 12381. You have 24 hours to complete verification at beian.miit.gov.cn: enter the verification code, the phone number, and the last six digits of the responsible person's ID. You get a maximum of five attempts; if unverified after 12 hours, the system auto-resends once. Past 24 hours, the filing is returned and must be resubmitted from scratch. The SMS recipient varies by filing type: first filings go to the subject responsible person, program-only additions or changes go to the program responsible person.

What happens after the filing number is issued?

The filing number auto-displays on the Mini Program's profile page once the program is published — no manual paste step. Keep entity data current: changes to the filing entity require a filing update.

Mini Program filing vs website filing vs ICP license — what's the difference?

Three separate registrations that share the same provincial communications administration pipeline. Any domain resolving to a mainland server must complete its own ICP filing — the Mini Program filing does not cover it. Paid services trigger the ICP license assessment, a separate instrument layered on the filing.

Can one entity hold multiple Mini Programs?

Yes. Ceilings are 5 programs for an individual subject, 5 for an individual industrial-commercial household, and 50 for an enterprise or other organization. Once one program under the same subject passes filing review, the admin console offers a material-reuse feature for subsequent programs.

Does the backend API domain need its own filing?

Yes. Any domain resolving to a mainland server must complete its own ICP filing. The Mini Program filing does not remove that requirement.

Do Mini Program filings really avoid the 2–4 week website wait?

Mini Program filings run their own documented stage windows: 1–2 working days for platform review, 24 hours for MIIT SMS verification, and 1–20 working days for provincial review. The 2–4 week figure refers to the website pipeline, not the Mini Program flow. For deeper questions on ICP filing in general, see the ICP FAQ hub.
